1) Scope of Work
PHOTOGRAPHER agrees to provide a Lifestyle Motherhood portrait session, for CLIENT, which includes a separate styling/wardrobe selection appointment (scheduled based upon PHOTOGRAPHER and CLIENT’s availability), professional hair and makeup, up to one hour of shooting, plus 5 favorite edited images with printing rights.
All additional images and products will be available for purchase upon delivery of CLIENT’s gallery.
2) Fees
PHOTOGRAPHER shall provide services for a total of $450, with a non-refundable deposit of $225 due at the time of booking. The remainder will be due at the start of CLIENT’s session. The session will not commence until full payment has been made.
3) Cancellations
Should CLIENT need to cancel for any reason, PHOTOGRAPHER shall retain the initial non-refundable deposit. CLIENT may transfer this deposit to a new session based upon PHOTOGRAPHER’s availability. Should the PHOTOGRAPHER need to cancel or reschedule due to sickness or an act of God (weather, studio flooding…), PHOTOGRAPHER shall find a next suitable date as soon as possible with the CLIENT. If no such date can be found, PHOTOGRAPHER shall refund CLIENT all moneys paid.
4) Image Processing and Delivery
Developing and processing images will take up to 3 weeks. Upon completion, images will be delivered to CLIENT, via an online gallery, if session has been paid in full.
5) File Resolution and Permission
All photographic materials, including but not limited to digital files, prints and proofs shall be the exclusive property of PHOTOGRAPHER. Prints and/or images purchased by CLIENT are for personal use only. CLIENT shall not sell or authorize any reproductions of said prints.
All purchased images will be high resolution and watermark-free, to be used solely for printing images for personal use by CLIENT. CLIENT is the only authorized users of any purchased digital files and shall not attempt to gain profit or monetary compensation through distribution of these files.
6) Model Release
By signing this agreement, CLIENT agrees to allow their images to be used by PHOTOGRAPHER for commercial use such as but not limited to: website, portfolio, self-promotion, marketing and professional competition without further notice.
7) Storage of Received Images
Purchase of high resolution images releases PHOTOGRAPHER of all responsibility to store or maintain edited or original files/images. It is the responsibility of the CLIENT to make sure all images received are backed-up and stored properly.
8) Loss or damage of film
Any loss or damage of film or digital files during scanning/processessing will result in CLIENT receiving a full refund of fees paid. CLIENT can choose to reschedule another session, and the PHOTOGRAPHER will credit CLIENT fees already paid. PHOTOGRAPHER is not responsible for any additional compensation.
